Terms & Conditions
Welcome to Pact. Pact is owned and operated by Relentless Research LLC (“Relentless Research”, “Pact”, “we”, “us”, or “our”). These Terms & Conditions (the “Terms”) are a legally binding agreement between you and Relentless Research LLC governing your access to and use of the Pact mobile application, websites, and related services (collectively, the “Service”). By creating an account, checking the acceptance box, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and 18+ Age Requirement
The Service is intended only for adults 18 years of age or older. By using the Service you represent and warrant that:
- you are at least 18 years old;
- the date of birth and all other information you provide is true, accurate, and current; and
- you are legally able to enter into this agreement.
You agree that providing false age information, or otherwise misrepresenting that you are 18 or older, is a material breach of these Terms. It is grounds for immediate termination of your account, and you agree to indemnify and hold Pact harmless from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of or related to your misrepresentation of your age or eligibility. Pact reserves the right, but is not obligated, to verify any user’s age or identity and to suspend or remove accounts that we believe belong to minors or that contain false information.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You may not share, sell, or transfer your account.
3. Health Disclaimer and AI-Generated Fitness Content
Pact is not a medical provider, and the Service does not provide medical advice. Pact may generate workout programs, training plans, suggestions, and other fitness content using automated systems and artificial intelligence (“AI-Generated Content”). AI-Generated Content and any other fitness information provided through the Service are for general informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, treatment, or supervision by a qualified physician, trainer, or other healthcare professional.
You acknowledge and agree that:
- AI-Generated Content may be inaccurate, incomplete, or inappropriate for your individual health condition, fitness level, or abilities, and is not individually reviewed by a licensed medical or fitness professional;
- you should consult a physician before beginning, modifying, or continuing any exercise program, particularly if you have any pre-existing medical condition, injury, are pregnant, or take medication;
- physical exercise involves inherent risks, including the risk of serious personal injury, heart attack or other cardiac events, stroke, disability, or death;
- you assume full responsibility for evaluating whether any program, exercise, or activity is safe and appropriate for you, and for stopping any activity that causes pain, dizziness, discomfort, or distress and seeking medical attention; and
- to the fullest extent permitted by law, Pact is not liable for any injury, health event, or harm resulting from your use of AI-Generated Content or any fitness content, programs, or activities accessed through the Service.
4. Interactions With Other Users and In-Person Meetings
Pact is a social and accountability platform that helps members connect, match, chat, and arrange to train or meet. Pact does not conduct criminal background checks on users and does not verify, vet, or endorse any user, their statements, or their conduct, online or in person.
You are solely responsible for your interactions with other users. You acknowledge and agree that:
- communicating with, matching with, or meeting other users — including meeting in person to train, work out, or otherwise — is entirely at your own risk;
- Pact has no control over and is not responsible for the conduct, identity, safety, statements, or actions of any user;
- you will use good judgment and reasonable safety precautions (for example, meeting in public places and informing someone you trust of your plans); and
- to the fullest extent permitted by law, you release Pact from, and agree that Pact is not liable for, any claim, injury, loss, or damage of any kind arising out of or related to your interactions or meetings with other users, whether online or offline.
5. Acceptable Use and User Content
You agree not to use the Service to harass, threaten, defraud, impersonate, or harm others; to post unlawful, abusive, or sexually exploitative content; to solicit minors; or to violate any applicable law. You retain ownership of content you submit but grant Pact a non-exclusive, worldwide, royalty-free license to host, display, and use it to operate and improve the Service. We may remove content and suspend or terminate accounts that violate these Terms.
6. Assumption of Risk and Limitation of Liability
By using the Service you knowingly and voluntarily assume all risks associated with physical activity and with interacting and meeting other users. To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, and Pact and its members, managers, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, death, or property damage, arising out of or related to your use of the Service. Where liability cannot be excluded, Pact’s total aggregate liability is limited to the greater of the amount you paid Pact in the twelve months before the claim or USD $100.
7. Indemnification
You agree to indemnify, defend, and hold harmless Pact, its affiliates, and their respective members, managers, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content, your interactions or meetings with other users, your violation of these Terms, or your misrepresentation of your age or eligibility.
8. Termination
We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or to Pact.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state and federal courts located in the Commonwealth of Virginia, and you consent to personal jurisdiction and venue there. To the extent permitted by law, you waive any right to a jury trial and to participate in a class action.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the version and effective date and may ask you to re-accept. Continued use after changes become effective constitutes acceptance.
